All disputes and claims tied to these Terms and Conditions along with any resulting tort claims need arbitration under mutual agreement with the American Arbitration Association or a chosen alternative service provider. This provision will be interpreted and enforced through the guidelines of the Federal Arbitration Act. The arbitrator possesses authority to determine the complete dispute scope which includes deciding the enforceability of this arbitration clause. The agreement to arbitrate will stay active after the Terms and Conditions termination.
Class Action Waiver
The Terms and Conditions permit only individual arbitrations so class arbitrations and class/representative/collective actions are prohibited.
THE PARTIES AGREE
A party must use their personal capacity to start claims against another party because they lack authority as class members or plaintiffs. Any arbitration under these terms operates as an individual process without allowing class or representative or collective proceedings that function as private attorney general actions against the other party.
Unless SFKB PRO and you consent otherwise to arbitration terms the selected arbitrator cannot combine multiple individuals’ claims nor lead any type of representative or class proceeding.
